The context described (I am one of those who had never heard of this guy) sounds like specific, directed, incitement to violence and crimes. The problem is the standard for this in law is so high. In many ways we need it to be but the downsides as shown here are many particularly in light of the spread of this and related content. The line 'he's already in the phones' was such a great way of explaining the threat.
